Recently, Mr. Murphy achieved three significant pro bono victories in unemployment cases:
1) In the first case, Mr. Murphy represented a hospital chaplain who had been fired for attendance issues. The Department of Unemployment Assistance (“DUA”) denied the chaplain's claim for benefits, citing failure to adhere to the employer's attendance policy. Mr. Murphy argued that the chaplain's actions were unintentional and the DUA agreed, thus reversing the decision.
2) In the second case, Mr. Murphy represented a former hospital employee of Jamaican descent who had been transferred to a new position due to COVID-19 and subsequently terminated. The employer contested the employee's unemployment claim, but Mr. Murphy cross-examined the employer and successfully argued that the employee had done nothing wrong. The DUA rejected the employer's case.
3) In the third case, Mr. Murphy’s client was accused of committing fraud in his unemployment claim. However, Mr. Murphy argued that the facts did not meet the legal definition of "fault" and the hearing officer agreed. As a result, the client was not charged interest or penalties, and received a “no fault" finding.
