This week, the Dorchester District Court ruled in favor of Attorney Murphy’s client, a landlord of several private properties in Mattapan. The client’s tenant sued for thousands of dollars in personal property damage from flooding. Attorney Murphy persuaded the Court to apply a strict interpretation of the lease agreement such that the landlord cannot be held liable for the water damage in question.
Interestingly, prior to trial the tenant rejected the landlord’s modest settlement offer. Thus, this case demonstrates reconciliation is often a better option than risky litigation.
